1. General Rules
Vendor Space Assignment: Vendor booth space is assigned by the event organizers and is based on the availability and size of the booth requested. The event organizers reserve the right to modify booth placements as needed for event flow and safety.
2. Fees & Payment
Non-Refundable Fees: All space fees are non-refundable unless the event is canceled by the organizers.
Payment Due: Full payment is required only after the application has been accepted by the organizers. Vendors will not be assigned a space until payment is received.
3. Booth Requirements
Space and Equipment: Vendors must provide their own tents, tables, chairs, and display materials. Electrical access includes one standard 110V outlet; additional power requirements will incur extra fees and need prior approval.
Cleanliness: Vendors are responsible for keeping their booth area clean and removing all trash at the end of the event. Please use the designated trash bins provided.
Permitted Items: Vendors are permitted to sell only items approved during the application process. Any unauthorized items may result in the removal of the vendor from the event.
4. Liability & Insurance
Liability Waiver: The Nicoma Park Founder's Day Festival, Liberty Fireworks, and Liberty Entertainment and its organizers are not responsible for any loss, theft, damage, or injury incurred by vendors, their employees, volunteers, or their property during the event.
Insurance: Vendors are encouraged to have liability insurance to cover any damages or accidents that may occur at the event. Proof of insurance may be requested.
5. Electrical Use
Power Access: Only one standard 110V electrical outlet is included with the Prime Location w/ Electricity or Double Space w/ Electricity options. Additional power needs must be disclosed and approved prior to the event.
Extension Cords: Vendors must supply their own outdoor-rated extension cords if electrical access is requested. Cords must be properly secured to avoid tripping hazards.
6. Conduct & Behavior
Code of Conduct: Vendors and their representatives must be courteous, professional, and comply with all local regulations. Unacceptable behavior, including harassment or disruptive conduct, may result in expulsion from the event without refund.
Alcohol and Tobacco: The sale or distribution of alcoholic beverages, tobacco products, and drugs is strictly prohibited.
7. Compliance with Laws
Local Ordinances: Vendors must comply with all local ordinances, health department regulations, and any other legal requirements. The event organizers are not responsible for securing any necessary permits or licenses for vendors.
8. Cancellations
Event Cancellation: In the event the Festival is canceled due to unforeseen circumstances (such as severe weather, natural disasters, etc.), vendor fees will be refunded if no alternative event date can be rescheduled.
Vendor Cancellation: Vendors wishing to cancel their participation must notify the organizers in writing at least 14 days prior to the event. No refunds will be issued after this time.
9. Force Majeure
Unforeseen Circumstances: In the case of circumstances beyond the organizers' control (such as natural disasters, strikes, pandemics, or acts of government), the Festival may be rescheduled or canceled, and the organizers are not liable for any losses or expenses incurred by vendors.
10. Marketing and Promotion
Use of Vendor's Name and Likeness: By participating in the event, vendors agree that the Festival may use their business name, logo, and booth photos for marketing purposes, including but not limited to social media, website promotions, and future event advertisements.
11. Amendments
Changes to Terms: The organizers reserve the right to amend these Terms and Conditions at any time. Any changes will be communicated to vendors in writing.
